Terms of Service

Welcome to ReadySet. These Terms of Service ("Terms") constitute a legally binding agreement between you and Botto Studio LLC ("Company," "we," "our," or "us") governing your use of the ReadySet mobile application and website (collectively, the "Service").

Please read these Terms carefully. By accessing or using ReadySet, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

1. Eligibility

To create an account and use ReadySet, you must:

  • Be at least 18 years old (or the age of majority in your jurisdiction)
  • Have the legal capacity to enter into a binding agreement
  • Be a parent or legal guardian if creating child profiles

By creating an account, you represent and warrant that you meet these eligibility requirements.

2. Description of Service

ReadySet is a family routine management application that helps children complete tasks through visual countdowns and sticker rewards. The Service allows parents to:

  • Create and manage family routines and events
  • Assign tasks to children
  • Track task completion and progress
  • Reward children with virtual stickers
  • Invite other parents or caregivers to the household

3. Account Registration and Security

3.1 Account Creation

To use ReadySet, you must create an account using a valid email address. You agree to provide accurate, current, and complete information during registration.

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Keeping your parent code secure from children

3.3 Account Sharing

Your account is personal to you. You may invite other adults to your household through the app's invitation feature, but you may not share your login credentials with others.

4. Subscriptions and Payments

4.1 Free and Paid Features

ReadySet offers both free features and premium subscription plans ("ReadySet Plus"). Premium features include access to additional sticker packs and other enhanced functionality.

4.2 Subscription Plans

ReadySet Plus is available as:

  • Weekly subscription
  • Monthly subscription
  • Annual subscription
  • Lifetime purchase (one-time payment)

Current pricing is displayed in the app at the time of purchase. Prices are subject to change with notice.

4.3 Billing and Renewal

  • All payments are processed through the Apple App Store
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
  • Your App Store account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage and cancel subscriptions in your App Store account settings

4.4 Free Trials

We may offer free trial periods. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription and you will be charged.

4.5 Refunds

Refunds are handled according to Apple's App Store policies. To request a refund, contact Apple directly through reportaproblem.apple.com.

5. Household Sharing

5.1 Inviting Members

You may invite other adults to join your household. When you invite someone:

  • They will be able to view and manage all household data
  • They can see child profiles, events, tasks, and progress
  • They can create and modify events and tasks
  • They cannot delete the household or remove the owner

5.2 Your Responsibility

As the household owner, you are responsible for:

  • Who you invite to your household
  • The actions taken by household members
  • Removing members who misuse the Service

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service or servers
  • Upload content that is harmful, offensive, illegal, or violates others' rights
  • Use the Service to harass, abuse, or harm others
  • Reverse engineer, decompile, or disassemble the app
  • Use automated systems or bots to access the Service
  • Circumvent any security or access controls
  • Create multiple accounts for fraudulent purposes

7. User Content

7.1 Your Content

You retain ownership of content you create, such as event names, task names, and custom avatars. By creating content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and display this content solely to provide the Service to you and your household.

7.2 Content Guidelines

User-created content must not contain:

  • Illegal, harmful, or offensive material
  • Content that violates others' intellectual property rights
  • Personally identifiable information of others without consent

8. Intellectual Property

8.1 Our Property

The ReadySet app, including its design, features, code, graphics, sticker artwork, and content, is owned by Botto Studio LLC and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission.

8.2 Feedback

If you provide suggestions, ideas, or feedback about the Service, you grant us the right to use this feedback without restriction or compensation to you.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • The Service will meet your specific requirements
  • Any results from using the Service will be achieved
  • Any errors or defects will be corrected

ReadySet is a tool to assist with family routines, not a substitute for parental supervision, judgment, or professional advice.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOTTO STUDIO LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so these limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless Botto Studio LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you create or upload to the Service

12. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

12.1 Informal Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at legal@readyset.do. We will attempt to resolve the dispute within 30 days.

12.2 Binding Arbitration

If we cannot resolve the dispute informally, you and Botto Studio LLC agree to resolve any disputes through binding individual arbitration, rather than in court, except that either party may bring claims in small claims court if eligible.

Arbitration will be conducted by JAMS under its Streamlined Arbitration Rules. The arbitration will be held in the county where you reside or another mutually agreed location. The arbitrator's decision will be final and binding.

12.3 Class Action Waiver

YOU AND BOTTO STUDIO LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

12.4 Opt-Out

You may opt out of this arbitration agreement by sending written notice to legal@readyset.do within 30 days of first accepting these Terms. Your notice must include your name, email address, and a clear statement that you wish to opt out of arbitration.

13. Termination

13.1 Termination by You

You may delete your account at any time through the app settings or by contacting us. Upon deletion, your right to use the Service ceases immediately.

13.2 Termination by Us

We may suspend or terminate your account at any time, with or without notice, for any reason, including if we believe you have violated these Terms. We may also terminate the Service entirely at any time.

13.3 Effect of Termination

Upon termination, your license to use the Service ends immediately. Provisions of these Terms that should survive termination will remain in effect, including Sections 8-12.

14. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes by:

  • Posting the updated Terms on this page with a new "Last updated" date
  • Sending an email notification to your registered email address
  • Displaying a notice within the app

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.

15. General Provisions

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to conflict of law principles.

15.2 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Botto Studio LLC regarding the Service.

15.3 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15.4 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

15.5 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.

15.6 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, government actions, or internet service failures.
